In a hotly contested case on behalf of Shift Managers against Avis Budget Car Rental, on January 12, 2015, KOL defeated Avis’ motion to decertify the case as a collective action. This will permit the case, litigated since 2008, to move forward towards trial. The decision was rendered by Chief Magistrate Judge Steven M. Gold of the federal district court for the Eastern District of New York. In a Report & Recommendation to the federal district court judge, he concluded the differences between the shift managers’ duties and responsibilities “paled in comparison” to their similarities in a report recommending denial of Avis’ motion for decertification.
